Irrevocable Trusts for Asset Protection
An irrevocable trust removes assets from your personal estate, placing them beyond the reach of future creditors, estate taxes, and legal judgments. The tradeoff is control. By relinquishing direct ownership, you gain protection that revocable structures cannot provide.
- Place assets beyond creditors’ reach
- Remove assets from your taxable estate
- Protection that holds up under serious challenge

How Irrevocable Trusts Protect Your Assets
When you transfer assets into an irrevocable trust, those assets are no longer legally yours. A creditor pursuing a judgment against you personally cannot reach assets that belong to a properly structured trust. This separation is the foundation of serious asset protection planning.
Not all irrevocable trusts are the same. The type of trust, the jurisdiction where it is formed, the identity of the trustee, and the timing of the transfer all affect how strong the protection actually is.
Once assets belong to a properly structured trust, a creditor pursuing you personally cannot reach them.
That separation is the foundation of serious asset protection. The tradeoff is control.
Types of Irrevocable Trust Structures
The right structure depends on your assets, your exposure, and your goals. These are the structures we use most often.
Domestic Asset Protection Trust (DAPT)
Available in Idaho and a limited number of other states. Lets you be a discretionary beneficiary of your own irrevocable trust while receiving creditor protection after a seasoning period.
Offshore Asset Protection Trust
Formed in jurisdictions such as the Cook Islands, Nevis, or Belize. Governed by foreign law that US courts cannot override, providing the strongest available protection.
Hybrid Trust Structures
Combines a domestic trust with an offshore component that activates under legal pressure. Daily accessibility with maximum protection when it matters most.
Special Needs Trusts
Protects assets for a beneficiary with disabilities while preserving eligibility for government benefits like SSI and Medicaid.
Irrevocable Life Insurance Trusts (ILIT)
Removes life insurance proceeds from your taxable estate while providing liquidity for heirs and estate tax obligations.
Charitable Remainder Trusts
Transfers assets to charity while providing income to you during your lifetime, reducing estate and capital gains taxes.
Idaho’s Favorable DAPT Laws
Idaho is one of fewer than twenty states that has enacted Domestic Asset Protection Trust legislation. Idaho’s statutes allow a person to be both the grantor and a discretionary beneficiary of an irrevocable trust while receiving creditor protection after an eighteen-month seasoning period.
This makes Idaho a particularly strong jurisdiction for domestic asset protection, even for clients who live in states without their own DAPT statutes. Moses Estate Planning has deep experience structuring Idaho DAPTs for clients across both states we serve.

Frequently Asked Questions
Generally no. The irrevocability is what creates the protection. Some structures have limited mechanisms for modifying or decanting a trust, but you should enter an irrevocable trust assuming the transfer is permanent.
Idaho’s DAPT statute requires an 18-month seasoning period before trust assets are fully protected from creditors who existed at the time of transfer. Claims arising after the transfer and seasoning period are generally protected immediately.
A DAPT is formed under US law and administered domestically, easier to manage but subject to US court jurisdiction. An offshore trust is formed under foreign law, placing it outside the reach of most US court orders, stronger protection but more complex and expensive to establish.
Not necessarily. Special needs trusts and irrevocable life insurance trusts are useful for clients at many asset levels. DAPTs and offshore trusts are more commonly used by clients with significant assets at risk.
